1. Acceptance of Terms

By creating an account, activating a card, linking a wallet, or otherwise accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an entity, you represent that you are authorized to bind that entity and “you” refers to that entity.

2. Eligibility & Regulatory Disclosures

  • You must be at least [Minimum Age] years old and capable of forming a binding contract.
  • You must pass our identity verification (“KYC”) and ongoing due diligence (“CDD”) checks as required by applicable anti-money laundering and counter-terrorist financing laws (“AML/CTF”).

4. Account Registration, Verification & Security

  1. Information accuracy. You agree to provide accurate, current, and complete information and to update it promptly.
  2. Verification. We may require identity documents, proof of address, and other information, and may use third-party providers to verify.
  3. Credentials. You are responsible for maintaining the confidentiality of your login, PIN, passcodes, device security, and for all activity under your Account.
  4. Security events. Notify us immediately at [Support Email] if you suspect unauthorized access, loss, or theft of your Card/device.
  5. Two-factor authentication. We may require 2FA or step-up verification for certain actions.

5. Card & Transaction Rules

  1. Permitted use. Use the Card/Account only for lawful, bona fide transactions for personal or business purposes as applicable.
  2. Funding & loads. Loads may be available via bank transfer, card top-up, or other methods we support. Availability varies by region.
  3. Authorizations. A transaction may appear as “pending” until settled or reversed. Merchants may place temporary holds.
  4. Limits. We may set or change load, spend, ATM, and velocity limits at any time for risk or compliance reasons.
  5. Cash access. ATM withdrawals may incur fees and third-party surcharges.
  6. Provisional credits. We may apply or revoke provisional credits for disputes or chargebacks.

  • Exchange rates. If your transaction currency differs from your Card currency, an FX rate and markup may apply.
  • Taxes. You are responsible for any taxes arising from your use of the Service.

7. Wallet Integration & Virtual Cards

  • You may add your Card to supported Wallets subject to the Wallet provider’s terms. Device eligibility and regional availability apply.
  • Keep your device secure (passcode/biometrics). You are responsible for Wallet transactions authenticated on your device.
  • Removing a Card from a Wallet does not close your Account.
  • Virtual cards may be issued for online use. Treat them like physical cards; do not share details.

8. Prohibited Activities

You agree not to use the Service for activities that are illegal, high-risk, or otherwise restricted by us or our partners, including:

  • Fraud, money laundering, terrorist financing, sanctions evasion.
  • Unlawful gambling, illicit substances, counterfeit goods, or IP infringement.
  • Adult content involving exploitation or non-consenting persons.
  • Shell/opacity structures designed to obscure beneficial ownership.
  • Any activity listed on our Prohibited Use List.

9. Transaction Disputes, Chargebacks & Errors

  1. Contact merchant first. Many issues resolve fastest with the merchant.
  2. Notify us. For unauthorized or incorrect transactions, contact us at [Support Email] within [X days] of the statement date.
  3. Investigation. You must provide requested information (receipts, communications, police reports for theft, etc.).
  4. Outcome. We will provide a written decision. Provisional credit may be applied or revoked based on scheme rules and evidence.

10. Lost, Stolen, or Compromised

  • Lock your Card in-app and notify us immediately at [Support Email].
  • You may be liable for transactions authenticated before you reported the loss/theft, as permitted by applicable law.
  • We may issue a replacement card and may charge a replacement fee.

11. Suspension & Termination

  • We may suspend or terminate access with or without notice for suspected violations, risk, or at our discretion where permitted by law.
  • You may close your Account at any time; outstanding fees/charges remain due. We may retain records as required by law.

12. Privacy & Data

Your use of the Service is subject to our Privacy Policy. We process personal data as a controller and/or processor, as applicable, and may share data with service providers and partners to operate the Service, meet legal obligations, and prevent fraud.

13. Third-Party Services

We may link to or integrate third-party services (e.g., Wallets, issuers, identity verification providers). We are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

14. Intellectual Property

The Service, including trademarks, logos, designs, software, and content, are owned by Company or our licensors and protected by law. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose.

15. Electronic Communications & Notices

  • You consent to receive notices and communications electronically (email, in-app, SMS, or via the website).
  • Keep your contact details up to date. Notices are deemed delivered when sent.

16. Disclaimers & No Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, timely, secure, or error-free operation.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE [12] MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) [€/$/£ Amount].

18. Indemnification

You agree to defend, indemnify, and hold harmless Company and our partners from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or violation of these Terms or applicable law.

19. Governing Law & Dispute Resolution

  • Language. Where these Terms are provided in multiple languages, the English version controls unless local law requires otherwise.
